Negosiasi Tanggung Jawab Nafkah Suami dan Istri dalam Perspektif Hukum Keluarga Islam

Abstract

This study aims to analyze the forms of maintenance negotiation between husband and wife and their implications from an Islamic family law perspective. The focus of the study is directed at how contemporary social practices influence the division of maintenance roles in Muslim families and how this is understood within an Islamic normative framework. This study uses a qualitative method with a case study approach. Data were collected through in-depth interviews, observations, and documentation of married couples experiencing the dynamics of maintenance distribution. These data were then analyzed descriptively and analytically with reference to Islamic legal sources. The results show that maintenance negotiations emerge in response to social changes, such as the wife's involvement in the public sector and the family's economic condition. These negotiations are carried out through mutual agreements that still consider the principles of justice, deliberation, and welfare, although normatively the obligation to provide maintenance rests with the husband. The implications of this study indicate that Islamic family law has the flexibility to respond to social realities, as long as it does not ignore the basic values ​​of sharia and the purpose of marriage.
