Implikasi Penerapan Konsep Plea Bargain Terhadap Penanganan Perkara Kekerasan Berbasis Gender Online (KBGO) Di Indonesia

The objectives of this study are twofold: first, to elaborate on the concept of plea bargaining as a new criminal procedural mechanism applicable and implemented in Indonesia; and second, to analyze the implications of applying plea bargaining in the handling of Online Gender-Based Violence (KBGO) cases. This study employs a normative juridical method, which examines legal systems using secondary data obtained from literature review and analysis of various legal sources. Based on the results and discussion, the author concludes that, according to Article 1 number 16 of the Indonesian Criminal Procedure Code (KUHAP), plea bargaining is a legal mechanism that allows defendants to admit their wrongdoing and cooperate during the investigation by providing supporting evidence in exchange for a reduced sentence. Although this mechanism can facilitate case resolution for the perpetrator, the author argues that plea bargaining should not be applied automatically in all cases. Legal considerations should not be based solely on the severity of the statutory penalty but must also take into account the nature of the offense and its impact on the victim. In cases of Online Gender-Based Violence (KBGO), for example, victims continue to bear social stigma and long-term psychological consequences, including shame, mental stress, and trauma, which may significantly affect their quality of life. This situation demonstrates that while plea bargaining may be efficient for the perpetrator, it does not necessarily reflect substantive justice for the victim.
